Terms of Service

1. Agreement

By creating an account or using RealAdFlow AI ("the Service"), you agree to these Terms. If you don't agree, don't use the Service.

2. Who can use the Service

You must be at least 18 and able to enter into a binding contract. You are responsible for keeping your login credentials secure and for all activity on your account.

3. Subscriptions and billing

• Paid plans are billed in advance through Stripe and renew automatically.
• You can cancel at any time; cancellation stops future renewals.
• Except where required by law, fees already paid are non-refundable. Plan limits (generations, landing pages, etc.) reset per the billing period.

4. AI-generated content

The Service uses AI models to generate marketing copy, captions, scripts, images, and landing page content from your inputs. AI output may be inaccurate, incomplete, or similar to other outputs. You are solely responsible for reviewing, editing, and approving any content before publishing or sending it.

Subject to these Terms and your payment of fees, you own the outputs you generate to the extent permitted by law. You grant us a limited license to host and display them so we can operate the Service for you.

5. Real estate advertising compliance

You are responsible for ensuring all ads, listings, captions, scripts, follow-ups, and landing pages you generate or publish comply with:

• Fair Housing laws and equivalent local rules.
• Brokerage, MLS, and association advertising guidelines.
• Platform policies (Meta, Google, TikTok, etc.).
• Telemarketing, email, and SMS rules (CAN-SPAM, TCPA, CASL, GDPR).

The Service provides marketing copy suggestions. It is not legal, financial, or compliance advice.

6. Acceptable use

You agree not to:

• Use the Service to generate illegal, deceptive, harassing, or discriminatory content.
• Impersonate another agent, brokerage, or person.
• Resell, sublicense, or repackage the Service without written permission.
• Abuse or attempt to bypass rate limits, plan limits, or security measures.
• Reverse engineer, scrape, or automate the Service except via documented APIs.

7. Lead capture and your visitors

When you publish landing pages, you act as the data controller for the leads collected through them. You must provide your visitors with appropriate notices, obtain any required consents, and handle their data lawfully.

8. Termination

We may suspend or terminate accounts that violate these Terms or that present security or legal risk. You can stop using the Service and request account deletion at any time.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated content will be accurate, compliant, or fit for any specific use.

10. Limitation of liability

To the maximum extent permitted by law, RealAdFlow AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, leads, or data. Our total liability for any claim is capped at the amount you paid us in the 12 months before the claim.

11. Changes

We may update these Terms. If changes are material, we'll notify you in the app or by email. Continued use after the effective date means you accept the changes.
